Welcome to The Website Store (the "Site"), a website owned and operated by The Website Store ("we", "us", or "our"). By using the Site, you agree to be bound by the following terms and conditions ("Terms and Conditions"), which constitute a legally binding agreement between you and The Website Store.

1-Acceptance of Terms and Conditions

By using the Site or any services provided by The Website Store, you agree to be bound by these Terms and Conditions, as well as any other guidelines, rules, or policies that we may post from time to time. If you disagree with these Terms and Conditions, we would advise you not to use our services.

2-Description of Services

The Website Store provides website design, website support and website hosting services to clients (the "Services"). Our team of web designers will create a website for you, and we will host and maintain the website for a monthly fee, which will be charged to a credit card on file.

3-Payment and Billing

We want to make sure you understand how billing works for your Services. Your monthly fee will be charged on the same day each month that you purchased your website on The Website Store. All charges are made in USD currency. When you buy a website from us, you agree to pay for at least 12 months of service.

If you decide to cancel your subscription before the 12 months are up, you will still owe the remaining amount, which will be charged to the payment method on file.

If there is an issue with processing your monthly payment, we will let you know by email (at the email address you provided). We'll make three more attempts to process the payment within seven days. If we can't process the payment after those attempts, your website will be taken offline until the payment is made.

Please note that The Website Store is not responsible for any damages that may result from your website being offline due to non-payment. We're here to help and answer any questions you may have about your billing or account.

4-Ownership of Website

We want to make sure that you understand your ownership rights when it comes to the website we create for you. As long as your subscription is active and in good standing, you retain full ownership of the website. Additionally, you are always the owner of the domain name, as well as all of the content and images associated with your website.

We are here to support you and your website, and we want you to feel confident and secure in your ownership. If you have any questions or concerns, please don't hesitate to reach out to us for assistance.

5-Unlimited Modifications

At The Website Store, we are committed to providing exceptional customer service and ensuring that your website reflects your vision and goals. To offer you the best possible experience, we provide unlimited modifications on the pages of your initial website design and content, allowing you to fine-tune your online presence until it perfectly suits your needs.

Scope of unlimited modifications:

Our unlimited modifications include making changes and adjustments to the images and content of the existing pages of your website. This ensures that you have the flexibility to refine the appearance and messaging of your site until it's just right.

Exclusions from unlimited modifications:

Please note that the unlimited modifications offer does not cover the addition of new pages to your website or the complete redesign of a page or the entire website. However, if you do wish to expand your site or explore a significant redesign, our team is more than happy to assist you. We will gladly provide a personalized quote for any requested modifications beyond the scope of the free offer.

6-Free Website redesign after 3 years

As part of our commitment to providing high-quality websites, we offer a free website redesign every 3 years to clients who remain subscribed to our service. This redesign will be offered under the same subscription that the client was initially subscribed to, and will not result in any additional charges. We will contact the client 1 month before the renewal date of 3 years after the first payment to arrange for the website redesign.

While the website redesign is optional, it is highly recommended in order to stay current with the latest design trends and best practices. This offer is non-transferable and non-cashable.

7-Limitation of Liability

The Website Store will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Site or Services, including but not limited to damages for loss of profits, use, data or other intangible losses.

8-Indemnification

You agree to indemnify and hold The Website Store and its affiliates, officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms and Conditions, or your violation of any law or the rights of a third party.

9-Modification of Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time without notice to you. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

10-Governing Law

These Terms and Conditions will be governed by and construed in accordance with the laws of the Province of Quebec in Canada, without giving effect to any principles of conflicts of law.

11-Dispute Resolution

Any disputes arising out of or related to these Terms and Conditions or the use of the Site or Services will be resolved through binding arbitration. The arbitration will take place in Montreal, Quebec. 

12-Entire Agreement

These Terms and Conditions, along with any other guidelines, rules, or policies posted on the Site, constitute the entire agreement between you and The Website Store and supersede all prior agreements, understandings, or representations, whether written or oral.
